PocketDPE Terms of Use

Effective date: October 13, 2026.

These terms are an agreement between you and London Moren, the individual developer who makes and runs PocketDPE ("we", "us"). They cover the PocketDPE app, its server and its website. Please read them with our Privacy Policy and Refund Policy.

1. Agreeing to these terms

By creating an account or using PocketDPE, you agree to these terms. If you do not agree, do not use the app. Your download from the App Store is also governed by Apple's Licensed Application End User License Agreement (the "Apple EULA"); these terms add to it, and if the two conflict about the app itself, the Apple EULA wins.

2. Who can use PocketDPE

3. Your account

Keep your sign-in details to yourself and tell us at support@pocketdpe.org if you think someone else has used your account. You are responsible for what happens under your account. One account is for one person.

4. Subscriptions, free trials and billing

5. What PocketDPE is, and what it is not

PocketDPE is a study aid. It lets you rehearse the oral part of an FAA practical test with an AI examiner and gives you practice feedback.

6. Acceptable use

You agree not to:

We may suspend or close an account that breaks these rules.

7. Your content

Your spoken answers, their transcripts and any feedback you send stay yours. You give us permission to store, copy and process them (including through the service providers listed in our Privacy Policy, such as OpenAI) only as needed to run PocketDPE for you, keep your history, and fix and improve the app. If you send us suggestions, we may use them without owing you anything.

8. Our content and other people's content

The app, its examiners, its question banks, its design and its software belong to us or our licensors and are protected by law. We give you a personal, non-transferable license to use them in the app for your own training while these terms apply.

Some content comes from others. FAA regulations, charts, figures, handbooks and the Airman Certification Standards, and National Weather Service data, are works of the U.S. government and are in the public domain. Fonts, icons and open-source software are used under their own licenses, listed in Acknowledgements. Names such as "FAA" belong to their owners and are used only to describe what the app helps you prepare for.

9. Changes and availability

We may change, add or remove features, questions or examiners, and we may stop offering PocketDPE. We do not promise the app will always be available or free of errors. If we stop offering a subscription you have paid for, you can ask Apple for a refund of the unused part.

10. Disclaimers

To the fullest extent the law allows, PocketDPE is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement. Some places do not allow these exclusions, so some of them may not apply to you.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, a failed checkride, or costs of retesting or retraining, arising from your use of PocketDPE. Our total liability for any claim about PocketDPE is limited to the greater of the amount you paid for PocketDPE in the 12 months before the claim and US $50. Nothing in these terms limits liability that cannot be limited by law.

12. Ending your use

You can stop using PocketDPE and delete your account at any time in Settings. We may suspend or end your access if you break these terms or if we stop offering the app. Sections 5, 7 (the part about feedback), 8, 10, 11, 13 and 14 continue after your use ends.

13. Governing law

These Terms are governed by the laws of the United States and of the U.S. state in which the operator resides, without regard to conflict-of-law rules. If you are a consumer, you keep any protection the law of the place you live gives you and cannot waive.

14. Apple

You and we agree that these terms are between you and us, not Apple. Apple is not responsible for PocketDPE or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims about it (including product liability, legal compliance or intellectual-property claims); we are, to the extent these terms and the law provide. If the app fails to meet a warranty that applies to it, you may tell Apple, and Apple may refund the purchase price; to the fullest extent the law allows, Apple has no other warranty obligation for the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

15. Changes to these terms

We may update these terms. We will change the effective date above and publish the new version in the app and on our website. If you keep using PocketDPE after that, the new terms apply.
